TERMS & CONDITIONS OF ENTRY

Event: Wine on Route 2026 Venue: Van Gaalen Cheese Farm (“the Venue”) Organizer: Van Gaalen Cheese Farm and/or appointed event management (“the Organiser”) Date(s): 8 & 9 August 2026 (or as advertised)

By purchasing a ticket, attending, entering, or remaining on the Venue, all persons (“Attendees”) agree to these Terms & Conditions.

1. GENERAL ACCEPTANCE OF TERMS

1.1 These Terms & Conditions apply to all persons entering the Venue, including ticket holders, guests, vendors, staff, contractors, and service providers. 1.2 Entry onto the Venue constitutes full acceptance of these Terms & Conditions. 1.3 If an Attendee does not agree to these Terms & Conditions, they must not enter the Venue.

2. RIGHT OF ADMISSION RESERVED

2.1 The Organizer reserves the right to refuse entry to any person for any reason deemed necessary for safety, compliance, or operational control. 2.2 The Organizer reserves the right to remove any person from the Venue without refund if they:

  • behave in a disorderly, aggressive, intoxicated, or unlawful manner,

  • damage property,

  • refuse to follow instructions,

  • endanger themselves or others,

  • violate these Terms & Conditions.

3. TICKETS AND ENTRY

3.1 Tickets are valid only for the date specified. 3.2 Tickets may not be duplicated, copied, resold, or transferred for profit. 3.3 The Organizer may request proof of purchase and identification. 3.4 Lost tickets, wristbands, or entry confirmations will not be replaced unless proven to the Organizer’s satisfaction. 3.5 The Organizer may implement security screening at entry points. 3.6 Entry may be denied if an Attendee is visibly intoxicated, aggressive, or unfit to attend safely.

4. EVENT CHANGES / FORCE MAJEURE

4.1 The Organizer reserves the right to change event times, schedules, activities, vendors, entertainment, routes, layouts, or offerings at any time without liability. 4.2 The Organizer shall not be liable for cancellation, delays, or modifications due to circumstances beyond reasonable control, including but not limited to:

  • severe weather,

  • fire,

  • flood,

  • load shedding or power failures,

  • strike action,

  • acts of God,

  • civil unrest,

  • government restrictions,

  • disease outbreaks,

  • supplier failure.

4.3 If the event is cancelled, refunds (if any) will be at the Organizer’s sole discretion, subject to administrative fees and costs already incurred.

5. ATTENDEE RESPONSIBILITY AND ASSUMPTION OF RISK

5.1 Attendees acknowledge that the Venue is an operational farm and outdoor environment and may include:

  • uneven terrain,

  • rocks, dust, mud, water crossings,

  • farm equipment and vehicles,

  • livestock or wildlife,

  • fences, gates, and agricultural infrastructure.

5.2 Attendees voluntarily assume all risks associated with attending the event, including but not limited to:

  • slips, trips and falls,

  • injury caused by terrain or weather,

  • injury caused by other attendees,

  • alcohol-related incidents,

  • food allergies or intolerances,

  • theft or loss of personal property,

  • vehicle-related incidents,

  • medical emergencies.

5.3 Attendance is entirely at the Attendee’s own risk.

6. INDEMNITY AND LIMITATION OF LIABILITY

6.1 To the maximum extent permitted by law, Attendees hereby waive, release, and discharge the Organizer, Van Gaalen Cheese Farm, its owners, directors, employees, contractors, agents, sponsors, suppliers, vendors, volunteers, and affiliates (“the Indemnified Parties”) from any and all claims, demands, actions, damages, liabilities, losses, costs, or expenses of any nature.

6.2 This includes (but is not limited to) liability arising from:

  • personal injury,

  • disability,

  • illness,

  • death,

  • loss or theft of property,

  • damage to vehicles,

  • loss of income,

  • emotional distress,

  • consequential or indirect damages.

6.3 This indemnity applies whether such loss arises from:

  • negligence (ordinary negligence),

  • omission,

  • defective equipment,

  • inadequate supervision,

  • unsafe conditions,

  • failure to warn,

  • actions of other attendees,

  • actions of vendors,

  • acts of third parties.

6.4 The Attendee agrees that the Indemnified Parties shall not be liable under any circumstances for any indirect, incidental, or consequential damages.

6.5 Where liability cannot legally be excluded, such liability shall be limited to the face value of the Attendee’s ticket price.

7. ALCOHOL CONSUMPTION

7.1 Alcohol may only be consumed by persons 18 years or older. Proof of age may be required. 7.2 No alcohol will be served to minors or visibly intoxicated persons. 7.3 The Organizer reserves the right to stop alcohol service to any individual at any time. 7.4 Attendees consume alcohol entirely at their own risk. 7.5 The Organizer accepts no responsibility for intoxication-related injury, death, damage, or misconduct. 7.6 Drinking and driving is strictly prohibited. 7.7 Any Attendee who drives under the influence will be solely responsible for all consequences.

8. FOOD, ALLERGIES AND HEALTH

8.1 Food and drink may be supplied by third-party vendors. 8.2 The Organizer does not guarantee allergen-free food or drink. 8.3 Attendees are responsible for managing their own allergies, dietary restrictions, and medical conditions. 8.4 The Organizer shall not be liable for allergic reactions, food poisoning, illness, or adverse health effects resulting from consumption of food or beverages.

9. MEDICAL ASSISTANCE

9.1 The Organizer may provide basic first aid services; however, this is not guaranteed. 9.2 Attendees remain responsible for their own medical costs and medical transport. 9.3 In case of emergency, the Attendee authorizes the Organizer to arrange emergency medical assistance at the Attendee’s expense.

10. CHILDREN AND MINORS

10.1 Parents/guardians are solely responsible for the supervision and safety of children/minors at all times. 10.2 The Organizer accepts no liability for injury, disappearance, or harm to children. 10.3 Children may not enter restricted areas such as farm operational zones, storage areas, animal enclosures, staff-only zones, or equipment areas. 10.4 Any child behaving unsafely may be removed with their guardian.

11. PARKING AND VEHICLE LIABILITY

11.1 Parking is provided as a convenience and may be on open farmland or gravel areas. 11.2 All vehicles are parked at the owner’s risk. 11.3 The Organizer shall not be liable for:

  • theft,

  • break-ins,

  • damage caused by weather,

  • damage caused by other vehicles,

  • damage caused by terrain or farm operations.

11.4 Attendees must follow all parking marshals and signage. 11.5 The Organizer reserves the right to tow or remove vehicles obstructing access, emergency routes, or farm operations at the owner’s cost.

12. PERSONAL PROPERTY AND THEFT

12.1 Attendees are solely responsible for safeguarding their belongings. 12.2 The Organizer accepts no responsibility for lost, stolen, or damaged items. 12.3 Any lost property handed in will be held for a limited period, after which it may be disposed of.

13. DAMAGE TO PROPERTY

13.1 Any Attendee who causes damage to property, equipment, livestock, fencing, buildings, infrastructure, signage, or vehicles shall be liable for the full cost of repair or replacement. 13.2 The Organizer reserves the right to lay criminal charges and pursue civil claims for damages.

14. BEHAVIOUR AND SAFETY COMPLIANCE

14.1 Attendees must behave responsibly and respectfully at all times. 14.2 No fighting, harassment, intimidation, vandalism, or threatening behaviour will be tolerated. 14.3 The Organizer reserves the right to remove any person without refund for non-compliance.

15. PROHIBITED ITEMS AND ACTIVITIES

The following are prohibited unless authorized in writing by the Organizer:

  • weapons of any kind,

  • illegal drugs or substances,

  • fireworks or explosives,

  • drones,

  • glass bottles (unless purchased on-site),

  • outside alcohol,

  • selling goods without vendor permission,

  • unauthorised commercial photography or filming,

  • loudspeakers or disruptive sound systems.

15.1 The Organizer may confiscate prohibited items and may involve law enforcement where necessary.

16. ANIMALS / PETS

16.1 Pets are not permitted unless specifically authorised. 16.2 Service animals are permitted but must remain under control at all times. 16.3 The Organizer is not responsible for injury or incidents involving animals.

17. WEATHER AND ENVIRONMENTAL CONDITIONS

17.1 This is an outdoor event and may take place in heat, wind, dust, rain, or cold conditions. 17.2 Attendees are responsible for appropriate clothing, sunscreen, hydration, and safety. 17.3 The Organizer accepts no liability for weather-related injuries, dehydration, sunstroke, or exposure.

18. PHOTOGRAPHY, VIDEO, AND MEDIA CONSENT

18.1 By entering the Venue, Attendees consent to being photographed, filmed, or recorded. 18.2 The Organizer may use such media for marketing, advertising, social media, and promotional purposes without compensation. 18.3 Attendees waive any right to inspect or approve final content.

19. VENDORS AND THIRD-PARTY SERVICE PROVIDERS

19.1 Vendors and service providers operate independently. 19.2 The Organizer is not responsible for:

  • product quality,

  • pricing,

  • service delivery,

  • refunds,

  • vendor conduct.

19.3 All purchases from vendors are at the Attendee’s own risk.

20. COMPLIANCE WITH INSTRUCTIONS

20.1 Attendees must comply with instructions from staff, security, marshals, emergency personnel, and management at all times. 20.2 Failure to comply may result in removal from the Venue without refund.

21. EMERGENCY PROCEDURES

21.1 Attendees must familiarise themselves with emergency exits and procedures. 21.2 In the event of evacuation, Attendees must follow instructions immediately. 21.3 The Organizer is not responsible for loss of property during evacuation.

22. GENERAL DISCLAIMER

22.1 The Organizer makes no warranties or representations regarding safety, suitability, or risk-free attendance. 22.2 Attendance is voluntary and at the Attendee’s own risk. 22.3 The Attendee acknowledges that risks may be unforeseeable and may arise at any time.

23. SEVERABILITY

23.1 If any clause is found invalid or unenforceable, the remaining clauses shall remain in full force and effect.

24. GOVERNING LAW AND JURISDICTION

24.1 These Terms & Conditions shall be governed by the laws of the Republic of South Africa. 24.2 Any disputes shall fall under the jurisdiction of the courts of South Africa.

25. ENTIRE AGREEMENT

25.1 These Terms & Conditions constitute the entire agreement between the Attendee and the Organizer. 25.2 No verbal agreements, representations, or promises shall be binding unless confirmed in writing by the Organizer.

ENTRY IS AT YOUR OWN RISK. Van Gaalen Cheese Farm and the event organizer's accept no liability for injury, death, loss, theft, or damage to property or vehicles, whether caused by negligence or otherwise, to the maximum extent permitted by law.
