Vaal Jazz Festival – Terms and Conditions

By purchasing a ticket and/or attending the Vaal Jazz Festival (“the Event”), you (“the Ticket Holder”, “Attendee” or “you”) agree to be bound by these Terms and Conditions, the venue rules, and all applicable laws of the Republic of South Africa. These Terms form a binding agreement between you and Mohanoe Group (“the Organiser”).

1.     Tickets and Admission

1.1 Tickets must be purchased only through official authorised channels (Computicket online, Computicket outlets, or other sellers officially designated by Mohanoe Group).

1.2 Each ticket admits one person only and is valid solely for the date, time and venue stated on the ticket.

1.3 Tickets are non-transferable and may not be resold, exchanged or used for commercial purposes without the prior written consent of Mohanoe Group. Unauthorised resale or transfer may result in the ticket being cancelled without refund.

1.4 A valid ticket (physical or digital) must be presented at the entrance. Lost, stolen, damaged, duplicated or forged tickets will not be accepted or replaced. Only the first valid presentation of a ticket will be honored.

1.5 Age restriction: Strictly 18 years and older. Valid photo identification may be required at the entrance. No persons under 18 will be admitted under any circumstances.

1.6 Right of admission is reserved. Mohanoe Group and venue management reserve the right to refuse entry or remove any person without refund for breach of these Terms, disorderly conduct, intoxication, or any other reasonable grounds.

2.     Refunds, Cancellations and Changes

2.1 All ticket sales are final. No refunds, exchanges or cancellations will be provided except in the event of full cancellation of the Event by Mohanoe Group.

2.2 If the Event is cancelled in its entirety by the Organiser, a refund of the face value of the ticket (excluding booking and service fees) will be processed via the original method of payment, subject to Computicket’s standard procedures.

2.3 If the Event is postponed or rescheduled, tickets will remain valid for the new date unless otherwise communicated by Mohanoe Group. No refunds will be issued for postponement.

2.4 Mohanoe Group reserves the right to change the line-up, running order, stages or any other Event details without prior notice and without entitlement to a refund.

2.5 The Event is an outdoor event and will proceed rain or shine unless conditions are deemed unsafe by Mohanoe Group or the relevant authorities. No refunds will be issued due to adverse weather.

3.     Entry, Security and Searches

3.1 All Attendees and their belongings are subject to search upon entry and at any time during the Event. Refusal to consent to a search will result in denied entry without refund.

3.2 Wristbands (if issued) must be worn at all times and may not be shared or transferred. Damaged wristbands will only be replaced upon presentation of the original ticket and the damaged band.

3.3 Re-entry may be restricted or subject to additional conditions as determined by Mohanoe Group on the day of the Event.

4.     Allowed and Prohibited Items

Allowed (subject to search and space availability):

·       Camp chairs / folding chairs

·       Gazebos / shade structures (reasonable size; must not obstruct views, walkways or emergency access)

·       Cooler boxes

·       Blankets and picnic rugs

·       Empty reusable water bottles

·       Personal medication and essential medical items

Strictly Prohibited:

·       Weapons of any kind, fireworks, flares or dangerous objects

·       Illegal substances or drug paraphernalia

·       Glass bottles or containers

·       Professional audio/video recording equipment (personal mobile phones are permitted)

·       Drones or remote-controlled aircraft

·       Pets (except registered service animals with valid documentation)

·       Any item deemed a safety or security risk by Mohanoe Group or security personnel

Confiscated items will not be returned. Mohanoe Group accepts no responsibility for items left at the entrance or confiscated.

5.     Conduct and Behaviour

5.1 Attendees must behave in a respectful, responsible and lawful manner at all times.

5.2 Violence, harassment, discrimination, damage to property, or any disruptive behaviour will result in immediate removal without refund and may be reported to the South African Police Service.

5.3 Mohanoe Group reserves the right to eject any person whose behaviour affects the safety or enjoyment of others.

5.4 Smoking is permitted only in designated areas (if any are provided).

6.     Liability and Risk

6.1 Attendance at the Event is entirely at the Attendee’s own risk.

6.2 Mohanoe Group, the venue owners, sponsors, Computicket and their respective employees, agents and contractors shall not be liable for any loss, damage, injury, death or theft of personal property arising from attendance at the Event, except to the extent required by applicable South African law (including the Consumer Protection Act 68 of 2008).

6.3 You indemnify and hold harmless Mohanoe Group and all related parties against any claims arising from your attendance or any breach of these Terms.

7.     Photography, Filming and Media

By attending the Event you consent to being photographed, filmed or recorded. Mohanoe Group and its authorised parties may use such images and recordings for promotional, marketing, commercial or archival purposes without compensation or further consent.

8.     Force Majeure

Mohanoe Group shall not be liable for any failure or delay in performance caused by circumstances beyond its reasonable control, including but not limited to acts of God, extreme weather, pandemics, government restrictions, strikes, power failures or artist cancellations.

9.     General

9.1 These Terms are governed by the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the South African courts.

9.2 If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

9.3 Mohanoe Group may amend these Terms at any time. The version applicable is the one in force at the time of ticket purchase or, if later updated and reasonably communicated, the updated version.

9.4 Purchase of a ticket and/or entry to the Event constitutes full acceptance of these Terms and Conditions.
