CHAFZAR TERMS & CONDITIONS FOR ITS SPINNING EVENTS
1. Brochure Descriptions and Prices
All descriptions and illustrations in the brochure and/or Facebook Page/website are intended to present merely a general idea of the event and should not form part of the contract. All information, prices and claims are correct to the best of our knowledge at the time of going to press. We reserve the right to amend information or prices relating to the event without notice. All prices include V.A.T. at the standard rate unless otherwise stated.
2. Supply of Events
We plan arrangements for spinning many months in advance. Very occasionally changes may be made and we reserve the right to do so. This may involve having to reschedule the timing and/or location of an event, possibly at short notice, owing to unavailability, booking numbers, safety, technical problems or other factors beyond our control. We cannot be liable for any costs incurred in any of these circumstances. We will try to provide a nearby alternative wherever possible or and a credit to be used against another event will be provided. This does not apply to the cancellation or suspension of an event due to force majeure (see below).
3. Lineups
We reserve the right to make changes to the lineup without notification. All details of our events are as accurate as possible but we reserve the right to substitute equivalent alternatives in all cases without notice and without liability.
4. Payment
Full payment is required at the time of booking. We are unable to reserve places or make provisional bookings.
5. Supplier's Terms
Upon booking or purchasing a ticket for any of our spinning events, you or your recipient and guests automatically agree to become bound by the terms and conditions that ChafZar may have. This is mostly to do with safety. Where there is any conflict in terms, ChafZar’s conditions apply. We cannot and do not accept liability in respect of faulty, unsatisfactory or non-performance by any spinning participant, nor any other claim, whether in contract or tort, arising out of the provision of the event by ChafZar.
6. Restrictions
Fans are not allowed on the spinning pitch during the show. Any unauthorised person found on the pitch will be evicted from the premises.
No weapons and firearms are allowed on our premises – weather by participants, their crew members, fans or their guests. Any breach of this condition will result in the offender being asked to leave the premises and/or total banishment from the venue.
7. Availability and Booking a Date or Purchasing a Ticket
All spinning events are offered subject to availability and weather conditions on the day. It may be necessary to book a date and pay for certain events well in advance due to demand.
8. Weather & Force Majeure
We reserve the right to cancel or suspend an event due to force majeure such as adverse weather conditions, safety reasons or any other matter beyond our control. We cannot be held liable for any costs incurred in this circumstance and there will be no refunds. If an event is cancelled due to weather or force majeure, a credit will be held and no refunds will be given.
9. Safety
Car spinning involves some personal risk, especially for the spinners and, to some degree, for fans. By participating in the motorsport, spinners and fans indemnify ChafZar from whatever claim may arise. By hosting the event, we do not give any warranty or guarantee as to the safety standards of any featured supplier or car spinner as they are independent contractors. To the best of our knowledge and belief, the spinners, many of whom are subject to rules and regulations by Motorsport SA, observe the highest standards of safety. We have not undertaken an official examination of the equipment or cars used in connection with any of the spinning events.
We reserve the right to refuse any person from participating in any spinning event should we deem it necessary. Whilst we consider this very unlikely to be enforced, this rule is for safety purposes only. We kindly ask you to respect that our professional staff's opinions are final and in your best interests. In this circumstance there is no compensation.
By participating in our spinning event(s) you hereby agree to indemnify ChafZar Spin City, its respective officers, owners and/or agents, and any third party engaged in organising, administering or participating in the said various activities in respect of my death or injury or loss or damage to my property or the property of any other party arising out of my participation in or attendance at any of the said activities.
The participant is solely responsible for any decision as to their fitness and ability to participate. The participant is aware that damage to their car is their own responsibility and will meet costs for any damage and/or wear and tear.The participant also agrees in the event of a car to car collision or damage caused to my car by any means they will not claim from any other guest or participant.
10. Refusal of Entry
ChafZar Spin City reserves the right to refuse entry to any person or persons or Companies. Any guest deemed under the influence of alcohol or drugs will not be permitted access to the pitch and will be removed from the venue immediately.
ChafZar Spin City lso reserves the right to refuse entry of any car or cars which are not deemed to be suitable for the venue/event attended.
VIP Tickets
Unless specifically stated as a ticket sale condition, catering is not provided with VIP tickets other than a welcoming drink. Food is sold on the premises. The VIP ticket simply ensures more privacy and comfort, proximity to the bar and dedicated waiters.
No unaccompanied kids are allowed in the VIP area.
VVIP Tickets
VVIP tickets are booked directly with ChafZar and come with catering as standard.
No children are allowed in the VVIP area.
Complaints
The easiest way of resolving complaints is to address them on the day. The event staff will endeavour to put things right immediately. If your complaint cannot be resolved immediately, send it to us in writing and we will respond promptly. We always look to improve the service we offer. This contract is made on the terms of these booking conditions which are governed by South African law and both parties shall submit to the jurisdiction of the local courts at all times.
