TERMS AND CONDITIONS

Event Name: The Biggest Easter Flea Market at the Vaal Dam

Event Dates: Friday 3 April to Monday 6 April 2026

Venue Locations: • YachtHaus Retreat, 22 Van Der Merwe Street, Deneysville, South Africa • Waterfront Activities Area, 23 Lake Avenue, Deneysville, South Africa

By purchasing a ticket, attending the event, participating in any activity, entering any competition, or trading as a vendor, you agree to be legally bound by the following Terms and Conditions. These Terms and Conditions apply to all attendees, vendors, contractors, exhibitors, staff, service providers, performers, and any other persons present on site.

1. GENERAL CONDITIONS OF ENTRY

1.1 Entry to the event is at the sole discretion of the Organiser.

1.2 The Organiser reserves the right to refuse admission, remove any person, or revoke access at any time without refund if these Terms and Conditions are breached, or if behaviour is deemed unsafe, disruptive, unlawful, or inappropriate.

1.3 All persons enter and remain on the premises entirely at their own risk.

1.4 Admission tickets are non-refundable, non-transferable, and may not be resold.

1.5 Event dates, times, activities, programmes, layouts, and attractions are subject to change without notice.

2. ASSUMPTION OF RISK

2.1 Attendance and participation involve inherent risks, including but not limited to injury, illness, property damage, theft, loss, crowd-related incidents, water-related activities, weather conditions, and interactions with third parties.

2.2 All attendees, vendors, and participants voluntarily assume all such risks, whether foreseen or unforeseen.

2.3 The Organiser makes no warranties or representations regarding safety conditions beyond reasonable operational measures.

3. LIMITATION OF LIABILITY

3.1 To the fullest extent permitted by South African law, the Organiser, venue owners, directors, employees, contractors, sponsors, service providers, and affiliates shall not be liable for any direct, indirect, incidental, consequential, or punitive damages, losses, injuries, illness, death, or claims of any nature whatsoever.

3.2 This limitation includes, without limitation, loss or damage to property, stock, equipment, vehicles, cash, personal belongings, or any other assets.

3.3 No liability is accepted for theft, loss, disappearance, or damage occurring before, during, or after the event.

4. INDEMNITY

4.1 All attendees, vendors, and participants indemnify and hold harmless the Organiser against any claims, demands, actions, damages, costs, or legal fees arising from: • Attendance at the event • Participation in activities or competitions • Sale or purchase of goods or services • Negligence, misconduct, or omissions by the indemnifying party • Breach of these Terms and Conditions

4.2 This indemnity applies to claims brought by third parties, including dependants, employees, customers, or companions.

5. WEATHER, FORCE MAJEURE & EVENT DISRUPTION

5.1 The event is weather dependent and takes place outdoors.

5.2 No refunds or compensation will be issued due to adverse weather conditions.

5.3 The Organiser shall not be liable for cancellation, delay, modification, or interruption due to force majeure events including but not limited to extreme weather, acts of God, government regulations, pandemics, strikes, security threats, or infrastructure failure.

6. HEALTH, SAFETY & MEDICAL

6.1 A First Aid station will be available on site.

6.2 Medical assistance is provided as a courtesy only and does not constitute acceptance of liability.

6.3 Attendees are responsible for their own medical conditions, medication, and health requirements.

6.4 Parents and guardians are solely responsible for the supervision, safety, and conduct of minors at all times.

7. CHILDREN & FAMILY ACTIVITIES

7.1 Children must be supervised by a responsible adult at all times.

7.2 Participation in Kids Zone activities, workshops, Easter hunts, and creative sessions is entirely at the child’s and guardian’s risk.

7.3 The Organiser accepts no responsibility for lost children, injuries, or incidents involving minors.

7.4 Lost child procedures are operational controls only and do not create a duty of care beyond reasonable assistance.

8. WATERFRONT & OUTDOOR ACTIVITIES

8.1 All waterfront, boating, fishing, and outdoor activities carry inherent risks.

8.2 Participation is voluntary and at the participant’s own risk.

8.3 The Organiser accepts no liability for drowning, slips, falls, watercraft incidents, or related injuries.

9. VENDORS & EXHIBITORS

9.1 Vendors trade entirely at their own risk.

9.2 Vendors are solely responsible for: • Legal compliance • Licences and permits • Product safety • Food safety and hygiene • Insurance • Staff conduct

9.3 The Organiser does not verify, audit, or assume responsibility for vendor compliance documentation.

9.4 Vendors remain fully liable for their products, services, pricing, representations, and transactions.

9.5 No guarantees are provided regarding foot traffic, sales volumes, or revenue.

9.6 Stall allocations and layouts are subject to change.

10. ZERO TOLERANCE & REMOVAL

10.1 The following are strictly prohibited: • Illegal or counterfeit goods • Unsafe products • Aggressive or deceptive conduct • Disruptive behaviour • Non-compliance with instructions

10.2 Breaches may result in immediate removal without refund or compensation.

11. COMPETITIONS & VOUCHER GIVEAWAY

11.1 The R10,000 Easter Mega Voucher Giveaway is open to valid ticket holders only.

11.2 One entry per valid ticket purchased.

11.3 The voucher is redeemable only at participating market stalls during the Easter weekend.

11.4 The voucher is not redeemable for cash and may not be exchanged or transferred.

11.5 The Organiser reserves the right to verify entries and disqualify any participant at its discretion.

11.6 The Organiser’s decision is final and no correspondence will be entered into.

12. PHOTOGRAPHY, VIDEO & MEDIA

12.1 The event is a public environment.

12.2 By entering the premises, you consent to photography, video recording, and audio recording.

12.3 The Organiser may use such material for marketing, promotional, and archival purposes without compensation.

13. PERSONAL PROPERTY & VEHICLES

13.1 All vehicles are parked at the owner’s risk.

13.2 The Organiser accepts no liability for vehicle damage, theft, or contents.

13.3 Personal belongings remain the sole responsibility of their owner.

14. ALCOHOL & SUBSTANCES

14.1 Alcohol consumption must comply with applicable laws.

14.2 Intoxicated persons may be refused entry or removed.

14.3 Illegal substances are strictly prohibited.

15. GOVERNING LAW

15.1 These Terms and Conditions are governed by the laws of the Republic of South Africa.

15.2 Any disputes shall be subject to the exclusive jurisdiction of South African courts.

16. SEVERABILITY

16.1 If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.

17. ACCEPTANCE

17.1 Entry to the event constitutes full acceptance of these Terms and Conditions.

17.2 Failure to read or understand these Terms and Conditions does not exempt any person from compliance.
