Terms and Conditions

for Fusion50 International Jazz Festival

1. Definitions

  • Festival – The Fusion 50 International Jazz Festival 2026, including all performances, activations, exhibitions, and related activities at Pont de Val and associated venues.

  • Ticket – Any valid entry pass, wristband, or digital ticket issued for the Festival.

  • Attendee – Any person entering the Festival venue.

2. Tickets & Entry

  • All attendees must possess a valid ticket for entry. Tickets are non-transferable unless expressly stated.

  • Tickets are revocable licences. The Organiser reserves the right to refuse entry or eject any person without refund if they breach these terms.

  • Lost, stolen, or damaged tickets will not be replaced

  • Refunds and cancellations are governed by the Consumer Protection Act. Reasonable cancellation fees may apply. No refunds will be issued for no-shows, late arrival, or ejection.

3. Prohibited Items & Conduct

The following are strictly prohibited:

  • Weapons, fireworks, glass bottles, illegal substances, drones, professional recording equipment (without prior written consent).

  • Unauthorised vending, promotions, or brand activations.

  • Any behaviour that is disorderly, abusive, racist, discriminatory, or endangers the safety of others.

The Organiser and security reserve the right to search persons and bags and to remove or destroy prohibited items.

4. Assumption of Risk & Liability Waiver

  • Attendance is entirely at your own risk.

  • The Organiser, its partners, sponsors, artists, contractors, and the venue shall not be liable for any loss, injury, death, damage to property, or any other harm suffered by you or your belongings, howsoever caused (including but not limited to negligence, except where such exclusion is prohibited by law).

  • You waive any and all claims against the Organiser and its associates arising from your attendance at the Festival.

  • You agree to indemnify the Organiser against any claims, losses, or damages caused by your actions or omissions.

5. Intellectual Property & Media Rights

  • All rights in the Festival name, logo, branding, and content belong exclusively to the Organiser.

  • By attending, you grant the Organiser and its partners an irrevocable, royalty-free licence to film, photograph, record, and use your image, voice, and likeness in any media worldwide for promotional, archival, and commercial purposes.

  • You may not make commercial recordings, live streams, or broadcasts without written permission.

6. Force Majeure & Event Changes

  • The Organiser reserves the right to change the line-up, dates, times, or venue without prior notice.

  • In the event of cancellation, postponement, or material change due to force majeure (including but not limited to weather, safety concerns, acts of God, war, pandemic, government regulation, or any event beyond our reasonable control), the Organiser shall not be liable for any losses, and refunds (if any) will be issued in accordance with the Consumer Protection Act.

7 Privacy & Data Protection

  • Your personal information will be processed in accordance with the Protection of Personal Information Act (POPIA). We may share data with official partners and service providers for the purpose of delivering the Festival.

8. Sponsor & Partner Protection

  • Official sponsors and partners enjoy exclusive category rights as agreed.

  • Unauthorised use of sponsor branding, ambush marketing, or competitive promotions is strictly prohibited and may result in legal action.

9. General

  • These Terms constitute the entire agreement between you and the Organiser.

  • If any provision is found to be invalid, the remaining provisions remain in full force.

  • The Organiser may update these Terms from time to time. Continued attendance constitutes acceptance of the updated terms.

10. Governing Law

  • These Terms and Conditions are governed by the laws of the Republic of South Africa.

  • You consent to the exclusive jurisdiction of the South African courts.

By attending Fusion 50 International Jazz Festival 2026, you confirm that you have read, understood, and agree to these Terms and Conditions.
