1. CANCELLATION, EVENT CANCELLATIONS AND ALTERATIONS
1.1. When buying Tickets, you acknowledge and accept that events can and do get cancelled, rescheduled or altered from time to time for any reason, and you accept the relevant provisions below will apply in such circumstances.
1.2. If an event is cancelled, rescheduled or materially for any reason whatsoever, we will use reasonable endeavours to notify you once we have received the relevant information and authorisation from the relevant authorities. However, we cannot guarantee that you will be informed of such cancellation, rescheduling or alteration before the date of the event. It is your responsibility to ascertain whether an event has been cancelled, rescheduled or altered and the date and time of any rescheduled event.
1.3. Cancellation: If an event for which you have purchased Tickets or Packages is cancelled in full (and not rescheduled), your order will be cancelled, and you will be refunded the Sale Price of your Tickets only.
1.4. If you have purchased Tickets or Packages for an event that takes place over several days and one or more days (but not all days) are cancelled, you may only be offered a proportionate partial refund, at the Event Director’s discretion.
1.5. Rescheduling: If an event for which you have purchased Tickets or Packages is rescheduled, Tickets and Packages will be valid for the new date once it is confirmed (or you will be offered Tickets or Packages of a value corresponding with your original Tickets or Packages for the rescheduled event, subject to availability).
1.6. If you notify us within the specified deadline that you are unable to attend the rescheduled event, you will be able to cancel your order and obtain a refund of the Sale Price of your Tickets.
1.7. Failure to notify us within any specified deadline that you are unable to attend the rescheduled event will be deemed to be a reconfirmation of your order for Tickets or Packages for the rescheduled event, and you will not be able to claim a refund.
1.8. Material Alteration: If an event for which you have purchased Tickets or Packages is “materially altered” (as defined in clause 11.5 below), Tickets and Packages will usually be valid for the altered event (or you will be offered Tickets or Packages of a value corresponding with your original Tickets or Packages for the altered event, subject to availability).
1.9. If you notify us within the specified deadline that you do not wish to attend the altered event, you will be able to cancel your order and obtain a refund of the Sale Price of your Tickets.
1.10. Failure to notify us within any specified deadline that you do not wish to attend the altered event will be deemed to be a reconfirmation of your order for Tickets or Packages for the altered event, and you will not be able to claim a refund.
1.11. For the purposes of this Purchase Policy, a “material alteration” is a change (other than a rescheduling, which can and does happen for a number of reasons, is a foreseeable possibility, and thus is not a material alteration) which, in our and the relevant Event Director's reasonable opinion, makes the event materially different to the event that purchasers of Tickets, taken generally, could reasonably expect. In particular, please note that the following are not deemed to be “material alterations”
1.11.1. the change of performances or entertainment offered;
1.11.2. adverse weather conditions;
1.11.3. changes of any supporting act;
1.11.4. changes to individual members of a band;
1.11.5. changes to the line-up of any multi-performer event (such as a festival, and which includes changes to headline acts even if already announced, which can and does happen from time to time and is thus not a material alteration); and/or
1.11.6. curtailment of the event where the majority of an event is performed in full; and delays to the starting of the performance of an event.
1.12. For accounting purposes in relation to cancelled events, your unused Tickets must be received by us within 28 (twenty-eight) days from the date of the cancelled event.
1.13. Refunds will be made using the same means of payment as you used for the initial purchase. 11.9. Cancellation by you: You are entitled to cancel your purchase of and return your Ticket(s) in accordance with clause 12 below
2. TICKET GUARANTEE
2.1. In addition to your rights under applicable laws, we operate our “Ticket Guarantee”, pursuant to which you are entitled to:
2.1.1. cancel the Ticket(s) in your order up to 60 (sixty) days prior to the event date (or the first event date if the Tickets relate to a series of events) and receive a full refund of the purchase price thereof less a cancellation fee equal to the relevant Service Charge in respect of such Ticket(s), in each case subject to the restrictions, terms and conditions, and fair use policy set out in the rest of this clause 2.
2.2. You shall not be entitled to any refund should you cancel the Ticket(s) in your order once there are 60 (sixty) days or fewer until the event date (or the first event date if the Tickets relate to a series of events).
2.3. If you want to exercise our Ticket Guarantee and make a request to cancel, exchange or upgrade the Tickets in your order. Please Email magusto@larstisabel.co.za.
2.3.1. We aim to acknowledge receipt of and review your Request within 3 (three) business days of receipt, and to process Requests within a further 5 (five) business days.
2.3.2. If your Request is successful and you are due a refund from us, it can take up to 14 (fourteen) days for the refund to be processed. Please note, refunds can only be made to the payment method used for the original order and cannot be refunded via any other method of payment.
2.4. You will be ineligible to benefit from the Ticket Guarantee if we have any grounds to suspect that:
2.4.1. you have in any way breached the terms of this Purchase Policy; and/or
2.4.2. you are acting fraudulently; and/or
2.4.3. you are acting contrary to the spirit of the Ticket Guarantee or in breach of the Fair Use Policy.
2.4.4. To the extent that you are a consumer for purposes of the CPA:
2.4.4.1. you hereby acknowledge and agree that the aforementioned cancellation charges constitute reasonable charges as contemplated in the CPA; and
2.4.4.2. notwithstanding the above, if you can provide us with proof that the person for whom, or for whose benefit, a Ticket was purchased will not be able to attend the Event because of his or her death or hospitalisation, no cancellation fee will apply in respect of that Ticket and you will receive a full refund of the Sale Price and Service Charge.
