1. By purchasing these tickets, the purchaser hereby confirms his/her agreement to be bound by these terms and conditions.
2. Melrose Arch (“the Organiser”) is the promoter of Carols by Candlelight (“the Event”). Tickets for the Events are sold by Melrose Arch to purchasers through the Computicket ticketing agents. Notwithstanding the terms and conditions of such ticketing agents which may apply to the sale of a Ticket for a particular Event, by purchasing and/or holding and/or being in possession of a Ticket or Tickets, the holder of the Ticket (“Ticket holder,” “you”, “your”) agrees to and is bound by these terms and conditions (“Ticketing Terms”). The Organiser reserves the right to amend these Terms at any time.
3. Proceeds from the ticket sales shall go to the SA Harvest and Drakensberg Boys Choir.
4. Attendees under the age of 18 must obtain parental or legal guardians’ prior authorization, permission and consent to attend the Event.
5. Each Ticket purchased is intended to give the ticket holder a revocable license (or right) to entry and attendance of the Event. All tickets for the event are of the same value and each ticket holder has a right to a seat at the Venue. The ticket holder agrees and acknowledges that no warranties or representations have been made regarding the accuracy of the location of the seat in relation to the stage as indicated on the seating plan prepared for the Venue, the availability of parking at the Venue and/or the adequacy of traffic control to or from the Venue.
6. For the safety of people at the Event, the venue management and the Organizer reserve the right to refuse admission and conduct security searches as they deem appropriate.
7. Tickets cannot be exchanged or refunded after purchase. There will be no refunds due to bad weather. This includes, but is not limited to inclement weather.
8. A valid Ticket must be produced for inspection to gain entry to the Venue upon request from an Event official at any time. Failure to produce such Ticket when requested may result access being denied to the Venue or in removal from the Venue.
9. Any alterations/misuse/abuse or fraudulent use of this ticket will render the ticket invalid.
10. Only Tickets purchased through the official Computicket platform will be valid. The organiser is not responsible for tickets purchased from third-party vendors and may deny entry to ticket holders without valid, official tickets.
11. A Ticket does not afford the Ticket holder the right to transport to the Venue, or parking, or merchandise, or any food or beverages at the Venue.
12. The purchase of Tickets is subject to the Organiser’s right to cancel or reschedule an Event at any time, or to alter or vary the programme of an Event, due to circumstances beyond the Organiser’s reasonable control. Where the Organiser alters or varies the program of an Event, the Organiser shall not be obligated to refund any Ticket monies or exchange Tickets.
13. If the event is cancelled, the order will be cancelled, and will be refunded the Sale Price of the Tickets.
14. If the Event is cancelled, the Organiser cannot be held responsible for any resulting costs incurred for travel, accommodation and other related goods, services or compensation.
15. Entry will not be permitted if it will disrupt the performance.
16. The Organiser reserves the right to refuse admission or to eject any person appearing to be intoxicated, under the influence of drugs, otherwise behaving dangerously or inappropriately, or for any other behaviour likely to cause damage, injury, nuisance and annoyance or for failure to comply with the reasonable request of the Organiser.
17. Please note that CCTV and film cameras may be present at the Venue. By purchasing Tickets and attending the Event, the ticket holder consents to being filmed, photographed, videotaped, or otherwise recorded be broadcasted, displayed or distributed (commercial or otherwise) without any compensation being paid to the ticket holder. The Organiser retains all rights to any media created at the event.
18. The ticket holder voluntarily assumes all risks and dangers incidental to an Event, whether occurring before, during or after the Event, and waives any claims for loss, damage, personal injury or death against the Organiser and/or Promoter, the management of the Venue, any agent of the Venue, the performing artist(s), participants, and all of their respective parents, affiliated entities, agents, officers, directors, owners and employees on behalf of the ticket holder and any minor accompanying the ticket holder.
19. To the fullest extent possible in law, we do not accept liability for and you will have no claim in respect of:
19.1. any claims relating to the location of your seat or standing place at the Venue; or
19.2. the quality of the view from your seat or standing place; or
19.3. any problems relating to the parking, adequacy of traffic control to and from the Venue; or
19.4. the quality of sound and lighting at the Event; or
19.5. the quality of any services provided by independent contractors at the Venue.
20.The organiser may collect and use your personal information in compliance with the Protection of Personal Information Act (“POPIA”) and applicable data protection laws. All personal data will be used solely for ticket processing, customer support, and event-related communications.
21. These Ticketing Terms shall be governed by South African Law and be subject to the exclusive jurisdiction of the South African courts.
